Formation of a demolition permit application in Algeria
The application for a demolition permit is submitted by the owner or agent of the demolition building or by the occupying public authority of the building. The following documents must accompany the demolition permit application:
• Copy of title contract, certificate of possession, or administrative contract.
• Agency or power of attorney if necessary.
• Blueprint (2000/1 or 5000/1)
• An outline measuring 1/500 of the building to be demolished or the part to be retained in the event of partial demolition.
• Detailed explanation of the reasons for the proposed demolition, with an account of the current conditions of use, the importance and nature of the waste, and the subject of site allocation after destruction.
• Where appropriate, expertise detailing the proposed demolition requirements.
Filing of the demolition permit application in Algeria
The file of the demolition permit application is deposited at the headquarters of the municipality where the demolition building is located in five 5 copies in exchange for a deposit receipt.
Study of the demolition permit application
The application for a demolition permit is examined by the local interests in charge of reconstruction within a maximum period of three 3 months from the date of the application's filing.
Issuance of demolition permits in Algeria
A demolition permit shall be issued in the form of a decision issued by the competent mayor regionally (the location of the demolition building). The applicant is not permitted to commence demolition until the 20-day date of obtaining the demolition permit and after being sent for the onsite start-up permit.
Publication of demolition permit
The receipt of the demolition permit application by the mayor is published at the municipal headquarters during the entire period of the application study. Residents of the municipality can oppose the handover of the building permit to the mayor.
Note: The demolition permit shall be declared null and void in the following cases:
• If the building is not demolished after 5 years.
• If the demolition is suspended for 3 consecutive years.
• If the court revokes the demolition permit.
Remedies for refusal to extradite a demolition permit
Anyone whose application for a demolition permit has been rejected shall have the right to lodge an administrative appeal or the entity that has rejected the application or followed up on it.
